Your safety, comfort, and overall experience are our top priority. By booking or participating in any Kinabalu ATV Adventure, all guests agree to comply fully with the policies outlined below. These policies ensure safety, protect the environment, uphold fair operating procedures, and provide clarity for both guests and our team.
1. Refund & Cancelation Policy
Booking & Cancellation by Guest
1.1 Free cancellation up to 72 hours before the scheduled activity.
1.2 50% refund for cancellations made 24–72 hours before the activity. This applies to guests who have paid in full online; the remaining 50% will be retained as a cancellation fee.
1.3 No refund for cancellations made less than 24 hours, late arrivals, or no-shows, including for guests who have paid in full online.
Weather & Safety Conditions
1.4 Activities operate in light rain and normal off-road conditions.
1.5 If the activity is cancelled by the operator due to severe weather or safety reasons, guests will be offered rescheduling or travel credit.
1.6 Cash refunds are not guaranteed and are subject to the operator’s discretion.
Travel Credit
1.7 Issued for the value of the original booking
1.8 Valid for up to 3 months from the original activity date
1.9 Non-refundable, non-transferable, and not exchangeable for cash
1.10 Subject to availability
Operator-Initiated Cancellation (Non-Weather)
1.11 If the activity is cancelled due to operational or technical reasons (e.g. ATV mechanical issues, guide unavailability), guests will be offered rescheduling or a full refund.
2. Arrival Time
2.1 Guests must arrive at least 30 minutes before the scheduled time.
2.2 Late arrival may result in a shortened activity or cancellation without refund, depending on operational constraints.
3. Safety Policy
Your safety is our highest priority. Our routes involve natural terrain, river crossings, slopes, mud, and uneven surfaces. All participants must follow the rules below.
3.1 Mandatory Safety Gear
All riders and passengers must wear helmets, harnesses (for passengers), protective gear when provided, and closed shoes. Staff may refuse participation if gear is worn incorrectly.
3.2 Compulsory Safety Briefing
All participants must attend the pre-ride briefing. Guests who skip or ignore the briefing cannot join the ride.
3.3 Guide Instructions
Guests must follow guide instructions on speed, distance, river crossings, slopes, and emergency procedures. Failure may lead to removal without refund.
3.4 Riding Behaviour
No reckless riding, overtaking without permission, sudden braking, swerving, drifting, wheelies, racing, or phone use while riding.
3.5 Alcohol & Drugs
Anyone suspected of being under the influence will not be allowed to ride and will not receive a refund.
3.6 Health & Physical Fitness
Do not join if you have serious heart conditions, uncontrolled asthma or epilepsy, are pregnant, have recent injuries, or cannot maintain balance or grip.
3.7 Equipment Use
Misuse such as forceful revving, damaging controls, riding into deep water without instruction, or leaving designated trails may result in charges.
3.8 Trail Safety Rules
Maintain safe distance, slow at corners and rough terrain, cross rivers only when instructed, stop when signaled, stay on marked trails.
3.9 Environmental Responsibility
Respect nature, avoid littering, avoid disturbing wildlife.
3.10 Authority of Guides
Guides have full authority to remove unsafe riders, adjust pace, stop rides due to hazards, or deny participation.
4. Liability Waiver & Risk Consent Policy
By participating, you acknowledge risks and accept full responsibility for your safety.
4.1 Voluntary Participation
You join voluntarily and understand the nature of off-road ATV riding.
4.2 Acknowledgement of Risks
You accept inherent risks such as falls, collisions, mechanical failures, uneven terrain, weather hazards, and physical strain.
4.3 Participant Responsibility
Participants must follow instructions, use equipment properly, and ride within their skill level.
4.4 Release of Liability
Kinabalu ATV Adventure is not liable for injuries, accidents, loss of belongings, death, or incidents caused by unsafe behaviour.
4.5 Passenger Consent
Passengers accept bumps, movements, slopes, terrain exposure, and mandatory harness use.
4.6 Equipment & Property Damage
Guests may be charged for damage due to negligence. Mechanical faults are not the guest’s responsibility.
4.7 Health Disclosure
Participants confirm they have no unsafe medical conditions, are not intoxicated, and are physically fit.
4.8 Binding Agreement
By booking or joining, you agree to this waiver and consent fully.
5. Driver Policy
5.1 Minimum Age
Drivers must be 16+. Under 18 must be accompanied by an adult.
5.2 Driver Responsibilities
Drivers must control the ATV safely, follow all instructions, maintain distance, avoid stunts, and report issues.
5.3 Physical & Fitness Criteria
Drivers may not ride if intoxicated, medically unfit, or injured.
5.4 One Driver per ATV
Switching drivers not allowed unless approved.
5.5 Safety Briefing
All drivers must attend the briefing and demonstration.
5.6 Route Restrictions
Alcohol & Drugs
Strictly prohibited.
5.7 Liability
Drivers accept responsibility for safe operation and damage due to reckless behaviour.
5.8 Guide Authority
Guides may stop unsafe drivers.
6. Passengers Policy
6.1 Age Policy
No minimum age; must wear helmet, harness, and be with a responsible adult.
6.2 Pricing
– 18 years and above: 50% of rider price
– Below 18 years: RM20 per passenger
6.3 Safety Requirements
Stay seated, forward-facing, hands inside ATV, no interference with steering.
6.4 When Passengers May Not Ride
Declined if cannot be secured, intoxicated, medically unfit, or terrain is unsafe.
6.5 Guide Authority
Guides may approve or decline passengers.
7. Attire & Equipment Policy
7.1 Mandatory Attire
Closed shoes, outdoor clothing, helmets, harness for passengers.
7.2 Recommended Items
Long sleeves, sunglasses, towel, change of clothes, waterproof pouch, sunscreen, repellant.
7.3 Prohibited Attire
Slippers, crocs, heels, skirts, dresses, loose accessories.
7.4 Equipment Provided
Helmet, harness, safety gear, ATV in good condition.
7.5 Personal Belongings
Guests responsible for belongings; exposure to mud/water expected.
7.6 Weather Attire
Quick-dry clothing recommended.
7.7 Fit & Safety Check
Guides will check helmets and harnesses.
8. Equipment Damage Policy
8.1 Guest Responsibility
Guests agree to use ATVs responsibly
8.2 Non-chargeable Wear
Mud, minor scratches, mechanical failure.
8.3 Chargeable Damage
Reckless riding, ignoring instructions, deep water entry, rollovers, misuse of controls.
8.4 Examples
Broken handlebar, bent suspension, damaged levers, cracked body, flooded engine.
8.5 Non-Chargeable
Manufacturing faults, non-negligent situations.
8.6 Assessment
Guide inspects, management reviews, costs explained transparently.
8.7 Security Rules
Do not tamper, switch ATVs, leave them unattended, or attempt self-repair.
9. Health, Fitness & Conduct
9.1 No refund will be given if a guest is unable to participate due to health conditions, intoxication, or failure to follow safety instructions.
9.2 All safety decisions made by guides or management are final.
10. Force Majeure
10.1 No refunds will be provided for events beyond the operator’s control, including natural disasters, road closures, or government restrictions.
10.2 Rescheduling or travel credit may be offered at the operator’s discretion.
